August 24, 2007 Letter from KCC, providing government with justification to re-evaluate the Sand Dollar area as a wetland.

re: PID #60467107 on Rte 332 in Rose Bay – Sand Dollar Beach area.

Dear Mr. Baker

As you know, KCC was concerned about the infilling begun on this property last winter, and we are still concerned about the owner’s stated intent to continue infilling. A crucial factor in determining the amount and type of development allowable by law is the existence of “wetland” on the property. In order to get a better idea of whether or not this property is a wetland, we invited Dr. Chris Miller to visit the area with us. Dr. Miller said, “Pretty much all of the land between the base of the infill from the edge of the highway to the intertidal zone along the beach would be considered to be ‘wetland’.” Dr. Miller’s comments and photos, included with this letter, describe a variety of reasons for his conclusion. We believe his observations provide sufficient justification for the appropriate government departments to take a closer look at the area in question and conduct an in-depth evaluation. Once this has been done, we would appreciate a written copy of the findings.
